1. Acceptance of Terms
Welcome to Breadyra, your artisan bakery for freshly baked breads, croissants, cinnamon rolls, buns, baguettes, cookies, muffins, and cakes. By accessing or using our website, creating an account, or placing an order, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or bakery services.
2. About Breadyra
Breadyra offers artisan breads, pastries and croissants, cakes and desserts, cookies and muffins, and fresh buns and rolls. Our bakery is located at Bernardo O'Higgins 1147, Copiapó, Atacama, Chile, and our online store is intended mainly for customers who can receive deliveries within the country or pick up orders locally. Features and bakery menu ranges may change over time, and we may update, suspend, or discontinue parts of the website without prior notice.
3. Use of the Website
You agree to use the website only for lawful purposes and in a way that does not harm Breadyra, other customers, or third parties. You must not attempt to gain unauthorized access to our systems, interfere with the operation of the website, upload harmful code, copy menu or product data automatically, or use the website to send unsolicited messages. You may not place orders with false information, misuse gift or membership benefits, or attempt to resell our bakery products in a way that misrepresents Breadyra.
4. Your Account and Information
Some features may require you to provide accurate and complete information, such as your name, email address, phone number, and delivery or pickup address. You are responsible for keeping your account details confidential and for all activity that takes place under your account. Please contact us immediately if you suspect unauthorized use. Accurate delivery details help us protect the freshness of breads and pastries during transport.
5. Products and Descriptions
We make every effort to display our bakery products, flavors, portion sizes, and prices accurately. However, screen settings may cause colors in cake photographs to look slightly different from the finished bake, and small variations in shape or garnish can occur because our products are handmade. Please consult the serving guide on each product page before ordering. Products are offered while stock lasts, and we may withdraw any item at any time. Allergen information is provided in good faith based on our recipes; please contact us if you need clarification before ordering.
6. Prices and Payment
All prices are shown in Chilean pesos unless stated otherwise and include applicable taxes. Delivery costs, when applicable, are shown before you confirm your order. We reserve the right to correct pricing errors, and if an error affects an order you have already placed, we will contact you so you can confirm or cancel the purchase. Payments are processed by secure third-party providers, and an order is confirmed only after the payment has been approved.
7. Orders and Acceptance
When you place an order, you receive an email confirming that we have received it. This confirmation is not an acceptance of your order. We accept an order when we begin preparing or dispatch the bakery products to you. We may refuse or cancel an order if items are out of stock, if payment cannot be verified, if a custom cake cannot be completed by the requested date, or if we suspect fraud or misuse. Custom messages on cakes must be lawful and respectful; we may decline text that we reasonably consider inappropriate.
8. Shipping and Delivery
We ship or arrange delivery to the address you provide, and we also offer pickup options when available. Delivery times are estimates and usually range from same-day windows in Copiapó to two to five business days depending on your region, but they may vary during holidays, peak celebration seasons, or because of circumstances outside our control. Please make sure someone is available to receive perishable bakery goods. Risk of loss passes to you when the order is delivered to the address provided or handed over at pickup. Store breads and pastries as recommended to preserve freshness.
9. Changes, Cancellations, and Freshness
Because our products are perishable and often baked to order, changes or cancellations of custom cakes and special bakes must be requested before production begins. Standard menu items that have already been baked or packed for delivery may not be returnable for hygiene reasons. If an order arrives damaged or clearly not as described, contact us promptly with photos so we can offer a replacement or refund where appropriate. Nothing in these terms limits your rights under Chilean Consumer Protection Law No. 19.496, including any right of withdrawal and warranty rights that apply to your purchase of bakery goods.
10. Quality and Branding
We bake our own artisan products and present them under the Breadyra name. Product photos, recipe names, and menu descriptions are intended to help you choose breads, pastries, cookies, muffins, and cakes with confidence. Any third-party ingredient trademarks mentioned on packaging belong to their respective owners and do not imply endorsement beyond ordinary ingredient use.
11. Intellectual Property
All content on this website, including text, photographs, graphics, the Breadyra name and logo, bakery menu layouts, and the layout of the site, is owned by Breadyra or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our materials without our prior written permission.
12. Limitation of Liability
To the fullest extent permitted by law, Breadyra is not liable for indirect, incidental, or consequential damages arising from the use of the website or from delays in delivery caused by events beyond our reasonable control, including weather or courier disruptions that affect perishable bakery items. Nothing in these terms excludes liability that cannot be excluded under Chilean law, including liability for products that do not conform to what was offered.
13. Governing Law
These Terms of Service are governed by the laws of the Republic of Chile. Any dispute will be handled by the competent courts of Copiapó, Atacama, Chile, without prejudice to the rights that consumers have under applicable consumer protection rules.
14. Changes to These Terms
We may update these Terms of Service at any time. The updated version will apply from the moment it is published on the website. Continued use of the website after changes means that you accept the new terms.
